Give should mandate truck owners to install dashcam. I have seen both the cases, where these truck drivers are reckless as hell, and where bikers are reckless as hell. In both cases biker ones were dead, but in latter truck driver was not at fault.

I would assume that killing someone would already be a punishable offence. Apparently there is another allegation circling that the punishment for a vehicle causing damage to a civilian was made by the British and was adopted as it is by Congressis. The reason they kept it low was because most vehicle owners were either British or loyal servants of the British and as such, they wanted to keep themselves safe legally in such cases where they killed "inferiors".

It’s convenient for us to say. This is essentially a 10-year sentence for the truck drivers even if it wasnt their fault. Yes, they might be rash at times but so are other drivers. And this will lead to police brutality and truckers being blamed for every road accident. What if a biker decides to kill themselves going 200 at the truck? This is more common than a lot of people think. I've seen so many accidents where idiot bikers are going 140/150 in a long corner, are unable to turn and go straight into a truck. In other cases they try to overtake trucks in centimetres distance and go straight under the wheel. Should truck drivers be punished for this? We need better laws not harsher ones.

The correct measure to stop hit and run is making the licence procedure better, more strict not imposing unreasonable fines and sentences. These are daily wage earners having 5-10k salary How will they pay fine or have sentences?

I lived in Chennai for my college. Worked part time and got myself a second hand bike to go to college. 3 months after getting it, I was at a light point and this truck was waiting beside me. The moment the lights turned green, the truck tried to make a sharp U turn, driving into my bike. I tilted it to get me some time and got off and he drove over both the wheels breaking one. Like actually cracked the axel. Didn't even look back and took off. 

Fuck these truck drivers. They have always evaded these punishments.

I don't much care for the BJParty, but I like this one. There should be accountability and due diligence, and criminal negligence should be punished. And I know truck drivers are a reckless bunch. 


However, there's a caveat. In India, whenever there's a vehicular accident, the 'bigger' vehicle almost always gets the blame, and there's the issue of mob vigilantism so maybe it could lead to some unforeseen problems.


Another point is that, I don't know how it'll play out in practice, but the law specified that it's for hit-and-run cases, not for those who hit-then-helped, although like I mentioned, if they did they could be subjected to mob vigilantism.


A good compromise would be to install dashcams on vehicles.

I met few truck drivers back at some dhaba and bro they literally accept they don’t stop once the hit someone qki ruk gaye toh ya toh jantaa maaregi warna truck palat jaayega. And I was also involved in one accident which fortunately left me alive and truck waale ne hi maara and before I could realize truck bohot aage nikal chuka tha. 

They basically want free pass to kill anyone unintentionally or intentionally that’s why they are protesting. Dumb fucks!

What if someone does it accidentally or someone regrets their actions ? why would they stop and help when they know they are going to jail for 10 years ?

Is punishing someone more imp than a life ? Rather than making the process easier these laws always make the end goal harder. These are short term solutions that do no good in the long term.

I think the point here is if the driver who caused the accident flees in fear of their life, but contact police afterwards once in a safe location, that person will get a fair investigation. 

Its for the people who flee after accident never to be tracked are the ones that will get the 10yr term once caught and prosecuted.

Truckers carrying goods for companies are under a great amount of stress. Low pay, inconsistent working hours. There’s a reason it was found out that truckers in the US were on drugs to keep them awake.

Prevention is always better than cure. Nobody can deny that a majority of hit and run cases are caused by negligent and subpar drivers. Strong laws work great when the base system is good, In this case the only thing its going to do increase the bribe for “settlement” and increase in fake cases.

The core of the problem is subpar drivers getting licenses just by paying few thousands and non enforcement of smaller laws like lane driving, right of way etc. In addition to that stray animals on the road, cyclists, e-rikshaws driving without lights - the list is endless. Just few days back there was a video of a gujarati man beaten up brutally by a mob when he asked people not to drive on the wrong side of the road. The audacity!

Its easier to say truck drivers are the worst, Almost everyone driving on our roads is a bad driver. My guess is more than 80% of the people cannot even identify the meaning of basic road signs, let alone follow rules. Why are such people being issued licenses? Why are rules not being enforced. Its certainly not a time problem because almost on every border I see lines of trucks and policemen extorting money from them. 

Whats the point of such laws when the core safety is missing from the roads and people following the rules have no recourse? This is a problem of quality and enforcement, it can only be solved at the root.

Playing devils advocate, I think it shows the low level of trust that truck drivers have with law enforcement. They get blamed for an accident irrespective of who is at fault and are usually easy scapegoats for cops to quickly close a case - not to mention the high risk of getting lynched in some places.

Ideally, the government needs to build trust - but knowing this government, very low chance of them taking anything back unless there is a chance of their electoral prospects being affected.

I understand that drivers are worried about extreme punishment and inaccurate/wrong judgements which can lead to false accusations. It can also lead to cases of corrupt officials taking benefit of circumstances of the driver or the companies they belong to.

The same way they are worried about their well-being shouldn't we also put our thoughts on the table as a member of general masses.

Some comments mentioned use of iron fist to break such protests. I don't think that's a solution. We must never forget we might be on the receiving end someday.

Truck drivers high on opium cause the most accidents. Hit and run laws exist in most countries why are they special? Rule of law must bring justice to people effected. In our small town. A truck driver fell asleep and plowed into a small school and killed 4 kids. Hes yet to be jailed 5 years on.

You seem to be a well informed young man. File a complaint on CP-GRAMS the grievance redressal forum managed by Central Government. The complaint will get redirected to the state government and will be on high priority. Keep multiple copies of the CCTV footage, print screenshots with date and time stamp and give it to a friend or relative away from your house. Meanwhile get ready to file a quashing and include all the evidence which you hae compliled alongwith the details of the property dispute

None of those charges will fly in court during trial. But your chances of getting the FIR quashed are slim. Get yourself a good trial court lawyer and he should be able to rip all witnesses apart in a matter of few questions in the cross. This might be a long battle. But an easy one if you have a right strategy. If you play your cards right, I can see the complainant begging you for settlement after the cross examination is over. If they don't, you'd get a clean acquittal. You should be able manage thus litigation with no anxiety. Or better yet, proceed for malicious prosecution against the complainant after the acquittal.

Firstly, never visit/try to confront the opposite party on your own
Visit police station with your lawyer &amp; family only.
Always keep video recording on, even when you're in a police station- It's legal.

Tell your sister to file a zero FIR from wherever she is, get them behind bars.
If they refuse, contact the state police complaint authority; get a copy of everything you do/report.

Get a senior lawyer who is associated with/well connected to a political party, tell him to approach the court- 
1.How the construction took place despite court's stay order?
2.File a case against the neighbours, seek compensation &amp; public apology for mental agony &amp; false charges, maligning reputation.
3.Seek damages for the destruction of your house.
4.Seek an enquiry, termination of the police officer who framed you into this &amp; the political goons be put behind bars for harassing you in jail premises.
5.Mention in court that you could've gone their way but you have faith in law &amp; order; your father who spent his career in the same field felt helpless due to political pressure &amp; your career is at stake due to their harassment, court is your last hope for justice.

For all- If there is a political angle in disputed property &amp; there's a slight chance the police/elected representatives might not help/go against you, get a good politically connected senior lawyer to take x% value of the property &amp; the headache too, so you don't involve in it directly, face harassment.
If he needs money, he'll try to settle the case quickly.
You focus on your career &amp; family, take care.

Yet another example of police doing their work for their own monetary benefit.  I'm sorry to hear this but the truth of the matter is that you will not get justice in our country.  Fact is you had to go through torture and an FIR is filed against you. Though the judge will throw the case away and acquit you, you will forever have this on record and this will come up in any kind of employment background verification checks.
